§ 1 Gegenstand der „Elephant Gin - Wildlife Warrior” Kampagne inklusive Rubbellos Gewinnspiel

Das Elephant Gin - Wildlife Warrior Gewinnspiel ist eine befristete Rubbellos-Gewinnspielaktion in Deutschland, United Kingdom, Italien, Österreich, der Schweiz, Zypern, Spanien und den USA der Firma Elephant Gin GmbH, Rosenstr. 3, 19243 Wittenburg.

Jeder Kauf eines Elephant Gin Cocktails im Rahmen der Elephant Gin - Wildlife Warrior Kampagne und Erhalt eines Rubbellos in teilnehmenden Bars* (Appendix I) berechtigt zur Teilnahme an dem Gewinnspiel, soweit der Teilnehmer in den Erhalt des Elephant Gin Newsletters sowie der Datenschutzrichtlinien eingewilligt und die Einwilligung nicht bis zum 12.10.2023, 23.59 Uhr widerrufen hat. Mit der Teilnahme an der Aktion akzeptieren die Teilnehmer diese Teilnahmebedingungen.

Die Gewinnspielaktion findet im Zeitraum vom 12.07.2023 bis zum 12.10.2023 statt. Innerhalb dieses Zeitraumes können Endverbraucher, die im Rahmen der Elephant Gin - Wildlife Warrior Kampagne einen Elephant Gin Cocktail kaufen und ein Rubbellos erhalten, an der Aktion teilnehmen. Die Eingabe des auf dem Rubbellos vorhandenen Glückscodes ist bis zum 12.10.2023 um 23.59 Uhr MEZ möglich.
Die Teilnahme am Gewinnspiel erfolgt ausschließlich im Rahmen dieser Teilnahmebedingungen. Mit der Eingabe des Glückscodes und der Angabe der Registrierungsdaten erkennt der Teilnehmer diese Bedingungen an.
Die Teilnahme am Gewinnspiel ist nur online über die Aktionswebsite www.elephant-gin.com/wildlifewarrior mit einem Glückscode möglich.

§ 2 Teilnahmevoraussetzungen

Die Teilnahme am Gewinnspiel ist online über die Aktionswebsite www.elephant-gin.com/wildlifewarrior möglich.

Teilnahmeberechtigt ist jede natürliche Person im Alter von mindestens 18 (21 in den USA) Jahren, die ihren Wohnsitz in Deutschland, United Kingdom, Italien, Österreich, der Schweiz, Spanien, Zypern oder den USA hat. Die Elephant Gin GmbH behält sich vor, das Mindestalter von 18 (21 in den USA) Jahren des Gewinners vor der Gewinnübergabe zu erfragen, um sicherzustellen, dass eine Übergabe nur an zur Teilnahme berechtigte Personen erfolgt.

Mitarbeiter der Elephant Gin GmbH, Mitarbeiter der teilnehmenden Bars (Appendix I) und sämtliche am Gewinnspiel durch Beauftragung von Elephant Gin GmbH beteiligten Personen sind von der Teilnahme ausgeschlossen. Die Teilnahme über Teilnahme- oder Gewinnspielanmeldungsdienste ist ebenfalls ausgeschlossen.

Alle Glückscodes können bis zum 12.10.2023 um 23:59 Uhr MEZ auf www.elephant-gin.com/wildlifewarrior hochgeladen werden.

§ 3 Gewinnspielteilnahme

Um an der Aktion teilnehmen zu können, muss der Teilnehmer nach Erhalt seines Rubbellos während des Aktionszeitraums auf die Aktionswebsite www.elephant-gin.com/wildlifewarrior gehen. Erforderliche Angaben des Teilnehmers sind Vorname, Nachnam, Bestätigung, dass der Gewinnspielteilnehmer mindestens 18 (21 in den USA) Jahre alt ist, und E-Mail-Adresse. Zudem setzt die Teilnahme am Gewinnspiel die Eingabe des Glückscodes unter dieser Aktionswebsite voraus.

Teilnahmevoraussetzung ist außerdem, dass der Teilnehmer in den Erhalt des Elephant Gin Newsletters eingewilligt und die Einwilligung nicht bis zum 12.10.2023, 23.59 Uhr widerrufen hat.

Zur Teilnahme an der Aktion muss der Teilnehmer die Teilnahmebedingungen und Datenschutzbestimmungen akzeptieren und bestätigen.

Des Weiteren muss der Teilnehmer versichern, dass alle Angaben wahrheitsgemäß und vollständig gemacht werden.

Der Teilnehmer erhält eine Bestätigung der Eingaben via Email und wird offiziell für das Rubbellos-Gewinnspiel registriert. Eine finale Auswahl der Gewinner nach dem Zufallsprinzip erfolgt am 13. Oktober 2023.

§ 4 Gewinne

Mit den Gewinncodes können insgesamt folgende Preise gewonnen werden:

Erster Preis: Drei Reisen (insgesamt - eine Reise pro Gewinner) zur Elephant Gin Distillery in der Rosenstraße 3, 19243 Wittenburg, Deutschland für den Gewinner und eine Begleitperson, die zum Zeitpunkt der Reise über 18 (21 in den USA) Jahre alt sind.

Zweiter Preis: 30 personalisierte Elephant London Dry Gin 500 ml Flaschen (insgesamt - eine Flasche pro Gewinner). Personalisiert nach Wahl des Gewinners (max. 25 Buchstaben). Botschaften, die Hassreden jeglicher Art, Beleidigungen gegen irgendjemanden oder irgendetwas oder Rassismus implizieren, werden nicht auf Elephant Gin Produkte oder Etiketten geschrieben. Die personalisierte Flasche wird mit einer Leinen-Geschenkbox und einer personalisierten Karte geliefert.

Dritter Preis: Bis zu 1.000 Kleinstgewinne wie Jutebeutel, Flaschenöffner etc. aus dem Elephant Gin Werbemittelbestand (insgesamt - ein Item pro Gewinner). Der Kleinstgewinn wird nach dem Zufallsprinzip oder je nach Verfügbarkeit ausgewählt. Die Gewinne werden mit einer personalisierten Karte geliefert.

Die Preise sind nicht übertragbar und nicht umtauschbar, und es werden keine Bargeldalternativen angeboten.

Wir behalten uns das Recht vor, Preise von gleichem oder höherem Wert zu ersetzen, wenn Umstände, die außerhalb unserer Kontrolle liegen, dies erfordern.

Die Entscheidung des Veranstalters zu allen Aspekten des Gewinnspiels ist endgültig und bindend, und es wird keine Korrespondenz darüber geführt.

§ 5 Gewinnmitteilung und Gewinnübergabe

Der Teilnehmer landet nach erfolgreicher Registrierung und Hochladen des Gewinncodes in einem Lostopf. Die Gewinner werden per Zufallsprinzip am 13. Oktober 2023 gezogen. Die Gewinner der Preise in der Gewinnstufe 1-3 werden innerhalb von 5 Werktagen per E-Mail benachrichtigt. Sie müssen im Folgenden über einen Link ihre Adresse, bestehend aus Straße, Hausnummer (ggf. Stiege/Tür), Postleitzahl, Wohnort in Deutschland, United Kingdom, Italien, der Schweiz, Österreich, Spanien, Zypern oder den USA, für Versandzwecke angeben.

Die Zusendung bzw. Übergabe der Gewinne erfolgt durch Elephant Gin GmbH in Abstimmung mit dem Gewinner.

Wir nutzen den DHL Service der Alterssichtprüfung. Aus Gründen des Jugendschutzes ist die Lieferung an Packstationen nicht möglich.

Elephant Gin GmbH ist nicht für Transportschäden oder -verluste der Gewinne an die Gewinner verantwortlich. Sollte aus Gründen, die beim Gewinner liegen, dieser per E-Mail nicht erreichbar sein und seinen Gewinn nicht antreten können, so verfällt der Gewinnanspruch 2 Wochen nach Gewinnbestätigung via E-Mail.

§ 6 Teilnehmerausschluss

Elephant Gin GmbH behält sich das Recht vor, Teilnehmer, die falsche Angaben im Rahmen der Registrierung machen, gegen die Teilnahmebedingungen verstoßen und/oder Manipulationen vornehmen und/oder vornehmen lassen, von dem Gewinnspiel auszuschließen.

§ 7 Haftung

Schadenersatzansprüche gegenüber Elephant Gin GmbH, deren Angestellten und Erfüllungsgehilfen und/oder verbundenen Unternehmen, die im Zusammenhang mit dem Gewinnspiel stehen, sind ausgeschlossen. Dies gilt nicht bei Vorsatz oder grober Fahrlässigkeit oder der Verletzung vertragswesentlicher Pflichten (Kardinalpflichten). Ferner haften Elephant Gin GmbH, deren Angestellte und Erfüllungsgehilfen und/oder verbundene Unternehmen nicht für Schäden aus der Beeinträchtigung der Verfügbarkeit der Gewinnspiel-Internetseite bei nicht beeinflussbaren technischen Störungen und Ereignissen höherer Gewalt, sowie von Dritten verursachten Störungen. Elephant Gin GmbH wird jedoch alles Zumutbare unternehmen, um die Zuverlässigkeit und Funktionsfähigkeit der Gewinnspiel-Internetseite sicherzustellen. Weiterhin haftet Elephant Gin GmbH nicht dafür, dass die Gewinnspiel-Internetseite auf dem jeweiligen Teilnehmerrechner ordnungsgemäß funktionsfähig ist.

Elephant Gin GmbH ist lediglich für die Durchführung der Gewinnspiel-Aktion mit Zusatzverlosung und die Bereitstellung der Gewinne verantwortlich, die dem Teilnehmer einen Anspruch gegen den jeweiligen Anbieter nach Maßgabe des Gewinnes verschaffen. Für die Erfüllung des Anspruchs aus den Gewinnen ist ausschließlich der jeweilige Anbieter verantwortlich. Es gelten die Angebotskonditionen sowie die AGBs des Anbieters.

§ 8 Sonstiges

Ausschließlich anwendbares Recht ist das Recht der Bundesrepublik Deutschland. Die Elephant Gin GmbH behält sich vor, das Gewinnspiel jederzeit ohne Vorankündigung zu beenden, wenn die Durchführung und/oder Abwicklung des Gewinnspiels aus rechtlichen und/oder tatsächlichen Gründen nicht gewährleistet werden kann. Sollten einzelne Bestimmungen dieser Teilnahmebedingungen ganz oder teilweise unwirksam sein und/oder werden, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt.

§ 1 Object of the "Elephant Gin - Wildlife Warrior" Campaign including scratch-card Competition

The Elephant Gin - Wildlife Warrior competition is a limited scratch-card lottery competition in Germany, the United Kingdom, Switzerland, Austria, Spain, Cyprus, the US and Italy run by Elephant Gin GmbH, Rosenstr. 3, 19243 Wittenburg.

Every purchase of an Elephant Gin cocktail as part of the Elephant Gin - Wildlife Warrior campaign and receipt of a scratch-card in participating bars* (Appendix I) entitles the participant to take part in the competition, provided that the participant has consented to receive the Elephant Gin newsletter as well as its privacy and cookie policies, and has not revoked this consent by 11.59 p.m. CET on 12.10.2023. By entering the promotion, entrants accept these terms and conditions.

The competition will take place between 12.07.2023 and 12.10.2023. Within this period, consumers who purchase an Elephant Gin cocktail as part of the Elephant Gin - Wildlife Warrior campaign and receive a scratch-card, can participate in the promotion. The code on the scratch-card needs to be entered until 12.10.2023 at 11.59 p.m. CET.
Participation in the competition takes place exclusively within the framework of these conditions of participation. By entering the code and providing the registration data, the participant accepts these terms and conditions.
Participation in the prize draw is only possible online via the promotion website www.elephant-gin.com/wildlifewarrior with a code.

§ 2 Conditions for participation

Participation in the competition is possible online via the promotional website www.elephant-gin.com/wildlifewarrior.

In order to be eligible to participate, every participant has to be at least 18 (21 in the US) years old and a resident in Germany, the United Kingdom, Switzerland, Austria, the US, Spain, Cyprus or Italy. Elephant Gin GmbH reserves the right to request to prove the minimum age of 18 (21 in the US) years of the winner before handing over the prize in order to ensure that the prize is only handed over to persons entitled to participate.

Employees of Elephant Gin GmbH, employees of the participating bars (Appendix I) and all persons involved in the competition by commissioning Elephant Gin GmbH are excluded from participation. Participation competition registration services are also excluded.

All codes can be uploaded to www.elephant-gin.com/wildlifewarrior until 12.10.2023 at 11:59 p.m. CET.

§ 3 Participation in the prize draw

In order to participate in the promotion, and on receiving the scratch card during the promotion period, the participant must go to the dedicated promotion website www.elephant-gin.com/wildlifewarrior. Required details of the participant are first name, surname, confirmation that the participant in the prize draw is at least 18 (21 in the US) years old, and an e-mail address. In addition, participation in the prize draw requires the entry of the code under this promotion website.

It is also a condition of entry that the entrant has consented to receive the Elephant Gin newsletter and has not withdrawn their consent by 11.59 p.m. CET on 12.10.2023.

To enter the promotion, the entrant must accept and confirm these terms and conditions and privacy policy.

Furthermore, the participant must assure that all information provided is truthful and complete.

The participant will receive a confirmation of the entry via email and will be officially registered for the scratch-card lottery. A final selection of winners will be made at random on 13. October 2023.

§ 4 Prizes

The winning codes can be used to win the following prizes:

First Prize: Three trips (total - one trip per winner) to Elephant Gin Distillery at Rosenstraße 3, 19243 Wittenburg, Germany for the winner and one accompanying person over the age of 18 (21 in the US) at the time of the trip.

Second prize: 30 personalied Elephant London Dry Gin 500 ml bottles (total - one bottle per winner). Personalised to the winner's choice (max 25 letters). Messages implying hate speech of any kind, insults against anyone or anything, or racism will not be written on Elephant Gin products or labels. The personalised bottle comes with a linen gift box and personalised card.

Third prize: Up to a 1.000 small items like e.g. tote bags, bottle openers etc. from the Elephant Gin existing items (total - one item per winner). The specific item will be selected by Elephant Gin at random or subject to availability. The item will come with a personalised card.

Prizes are non-transferable and non-exchangeable and no cash alternatives will be offered.

We reserve the right to substitute prizes of equal or greater value if circumstances beyond our control so require.

Elephant Gin’s decision on all aspects of the prize draw is final and binding and no correspondence will be entered into in respect thereof.

§ 5 Winning notification and prize handover

After successful registration and uploading of the winning code, the participant will be placed in a lottery pot. The winners will be drawn at random on 13. October 2023. The winners of the prizes in prize levels 1-3 will be notified via e-mail within 5 working days. They will need to provide Elephant Gin GmbH with additional information, in order to be able to ship prices via mail: street, house number (staircase/door if applicable), postcode, place of residence in Germany, the UK, Italy, Spain, Cyprus, Switzerland, Austria or the US.

Elephant Gin GmbH will send or hand over the prizes in consultation with the winner.

We use the DHL age verification service. For legal reasons of youth protection, delivery to PO boxes or other drop off locations is not possible.

Elephant Gin GmbH is not responsible for any damage or loss of prizes in transit to the winners. If, for reasons attributable to the winner, he/she cannot be reached by e-mail and cannot claim his/her prize, the claim to the prize shall lapse 2 weeks after confirmation of the prize via e-mail.

§ 6 Exclusion of participants

Elephant Gin GmbH reserves the right to exclude participants from the competition who provide false information during registration, violate the conditions of participation and/or carry out manipulations and/or have manipulations carried out.

§ 7 Liability

Claims for damages against Elephant Gin GmbH, its employees and vicarious agents and/or affiliated companies in connection with the competition are excluded. This does not apply in the event of intent or gross negligence or the breach of material contractual obligations (cardinal obligations). Furthermore, Elephant Gin GmbH, its employees and vicarious agents and/or affiliated companies are not liable for damages resulting from the impairment of the availability of the competition website in the event of technical malfunctions and force majeure events that cannot be influenced, as well as malfunctions caused by third parties. Elephant Gin GmbH will, however, make every reasonable effort to ensure the reliability and functionality of the competition website. Furthermore, Elephant Gin GmbH is not liable for the proper functioning of the competition website on the respective participant's computer.

Elephant Gin GmbH is only responsible for the implementation of the competition campaign with additional prize draw and the provision of the prizes, which provide the participant with a claim against the respective provider in accordance with the prize. The respective provider is exclusively responsible for the fulfillment of the claim arising from the prizes. The offer conditions and the general terms and conditions of the provider apply.

§ 8 Miscellaneous

This agreement will be governed by the laws of the Federal Republic of Germany. Elephant Gin GmbH reserves the right to terminate the competition at any time without prior notice if the implementation and/or execution of the competition cannot be guaranteed for legal and/or factual reasons. Should individual provisions of these conditions of participation be and/or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
